6 years expiry - vacation outside US

Hi,

I came to US on H1B visa on October 1st 1997. My 6 years will be up on Sept. 30th 2003.

During this period, I've spent over 7 months outside of US on vacation. Out of these 7 months, around 5 months were spent over 3 different occassions of 45 or more days each.

Q1. Can I add atleast these 5 months (if not 7) towards my 6 year period?

Q2. I already have an H1B visa valid till Feb. 2004. If the answer to Q1 is yes, do I need to file an extension for period beyond Sep. 2003? Can I simply stay back till Feb. 2004 without informing INS since I spent 5 months outside US?

Q3. Is the Departure/Arrival record on my passport enough to prove my time spent outside US?

My case is similar to your still waiting for the reply. Just let me know also if you hear anything. I have also contacted my lawyer on this. Will update here as I know more about it.

I have a situation. My visa is valid upto 10th June '03 when I actually came to USA in Sept 29th '97 My question is if math is done it does not total to 6yrs I should have 4 more months to go. Can I get another extension? if so, what should be done? if not what is alternative? Please advice.

NOTE: . I already have one extension. Applying to GC right away.
