Both My wife and I are working under H-1B status now. My wife's H1B started in year 2002, she renewed it once in 2005 and it will expire in 2008. My H1B's first 3-year period will expire soon and the employer will file I-129 to have it extended for another 3 years, which will expire in 2010.
I'm planning to change my wife's status from H-1B to H4 as my dependent right now, but can I ask USCIS to grant my wife H4 status which is valid through 2010 when my H-1B status expires? Or the 6-year limitation applies to H4 too, which means my wife's H4 wouldn't be valid after 2008?
