6 year H1 Expired Need 7 year H1

My 6 year H1 and I-94 expired in June 2003 and since then I have been working on EAD.My I-485 is pending since 1.5 years.Can I apply for 7 year H1B Now? ( I need to get my wife on H4 else I will have to take the Follow to join route).

To be honest I don’t know the answer for your situation as you used EAD and did not filed 7th year extension before June 2003. You should speak to knowledgeable attorney and ask if you can file for NEW H1 while AOS is pending
