Hello

I got laid off from company A, but they said they are going to continue with GC processing.
Here are the GC details, EB3, Non-RIR, NJ, VSC
GC Applied - March 1998
Labor Approved and Applied for I-140 in May and RD-July 19th

I joined a company B on a new H1 and my 6yr H1 expires in Feb 2002. Can I get my H1 extended beyond 6 years by Company B as I have my Labor approved(Even though from company A) and I-140 pending or approved by Feb 2002?

Please let me know about it. If anyone of you have gone through this experience..please let me know. Your help is appreciated.

Thanks!!

its possible

i think is possible..for you to get a H1B 7th year extension from your comp B, since its
been past 365 days you applied for LC. I think thats what matters --
for more info see AC21 www.isn.org for recent info from ins.

No Title

I think you will be OK. The law / INS guidance does not say that you have to be working on H-1 and applying for GC with the same company.

I have the same problem..

But the problem is that my labor certification was not cleared, but it was filed on january 2001 with my company , in this case company A.

There is something I can do, what if I can make company A to still working on my gc process, can I get a job under a new H1b?
and what would happen if I need to extend my h1b ?

layoff after I140 approval and while waiting for dates to be current.

I was approved a H1 transfer for three years, though my 6 years expire in few months. I think it was due to the fact that my h1 transfer took place while I was waiting for my case to become current.
It may also be a mistake on the part of INS, I am not sure.
What do you guys think?? Can I take benifet of my approval, if its a mistake by INS? Please advise.

Thanks,
Sunny

A sincere question from a person laid off and facing H1 six years ending term

I have been laid off during my I140 processing. It is not yet approved but will be aproved soon. My h1 6 years term expires in 6 months.
Q1. How is it possible for my ex-employer to continue my green card processing? How can they file my I485 even if I am not employed with them.

q2. Is it possible that even if my earlier GC process ends because of my layoff and another employer files for my H1, to get an extention beyond six years on my H1?
Any help will be sincerely appreciated as soon as possible.

Thanks.
A
