6 months without work - after GC - desperate.

Dear friends,

I got my GC two years back. My company who sponsored the GC for me had an agreement with my client and so I joined the client after 2 months of receiving the GC since my consulting company received money for me.It was mutual. After one year with the client I was laid off due to restructuring. I worked again for another company. I worked in this particular U.S State (Atlanta) for 4 consecutive years. That means my employers would have paid the taxes for unemployment.

Now that I am without a job,is it okay for me to claim unemployment? Is that a public charge? Will it cause any deportation or citizenship Issues? I am without a job for 6 months.I do not think I can survive without unemployment.

I read the public charge link in the INS site and there is no mention for unemployment.Is it okay then?

Unemployment insurance is not public charge as it is not paid by government. You and your employer have paid into an insurance fund which pays back to those who are unemployed and eligible to get UI. Please check my posts that have details of UI.

Hi Thank for the info.Could you please post the link you are talking about. I searched and could not find. And I am unable to search with UI since only two charachters. Thanks a lot.

There is no black and white official statement that clarifies this issue. But my understanding came about by gathering information from various websites.
One of the often mentioned reasons for not claiming UI while being an adjustee is that it makes you a PUBLIC CHARGE. I checked the definition of public charge at BCIS website. Please see this link for a comprehensive definition of public charge. It spells out what does and does not constitute poblic charge for both LPRs and adjustees. It is an official intrepretation from BCIS.

I also checked the website of California state UI program. This site details eligibility requirements for claiming UI. The link is:

If one is unemployed at the time BCIS calls you for interview, you are probably out of luck for getting the GC approved but that is NOT because you applied for UI. If you have no job at the time of approval, BCIS can deny GC.
My argument has been that claiming UI is NOT public charge since UI is not paid by taxpayer or government money. It is paid by an insurance fund. Both you and your employer pays regular premiums into this fund.
If BCIS ask you and you do not have a job, BCIS can deny GC. If you have a job, they probably will approve your GC, regardless of any UI claims.

...People without at least a GC usually can't claim UI..
Even adjustees who have unrestricted work authorization (EAD) can claim UI. At least EAD is an acceptable document in California for making a UI claim.
 
If you wanted to claim UI, would you have to claim it
right after layoff? Would it be too late to claim after
6 month since layoff?

If economy remain sluggish this way , a lot of immigrants
will be forced to move back. Now more and more projects
are being outsourced overseas
 
The outsourcing stuff may be overbown in the press, but if there no check in place, it will become a norm in the industry. Like the saying goes, "if you are out of a job, unemployment for you is 100%"
I see everyday more and more jobs going to India and elsewhere, and will never come back.
