6 months passed no EAD/AP/140/485.....

Can somebody guide me what to do?????????????????????????????????
 
Check with your lawyer, you should have got an RFE on your EAD/AP, or you should be getting wthin the next few days.

Here's my take on this, assuming you are from either from India/Phillipines/China. You stated that you are in the EB3 category.

Your PD is way ahead of the cut-off date for EB3 category which is somewhere in mid-2003. Since you are not eligible to file I-485 and it's ancillary (EAD and AP) applications.... USCIS has put it on hold.

If you are not from one of the I/P/C countries....then do not have an explanation for the EAD and AP on hold.

PD really does not matter for EAD and AP. All it is required is pending I-485 and has applied it before the retrogression. Did you ask what is the reason for hold?

Called VSC received a letter saying.....

"On all concurrently filed applications a prima facie review is conducted upon receipting of the applications. If any initial evidence required at the time of filing is missing from the I-140 application, a processing hold is placed on all other concurrently filed applications and a request for additional evidence is sent on the I-140 application. All processing hold remains until the request for addintional evidence is received and reviewed at this center."

Then I contacted my Lawyer. He said that he did not received any RFE or anything on I-140 till now.

Donno what is going on....................

Hi guy's

my current EAD is expiring on july 7th and I have applied my EAD for the renewal on may 25th.
I am not sure if my EAD will approve prior to the expiry of the current EAD?

in that case can i legally work on bassis of pending EAD?

No, you cannot work on the basis of pending EAD. But you can obtain an Interim Ead from your local USCIS office. But this can be obtained only if you cross 90 days (from the Receipt date) of your EAD filing.

I have read from some of the threads, that you can receive I-EAD even before 90 days have passed. But you need to show the emergency of getting I-EAD that is like you may loose your job/benefits(getting a letter from your HR about the job). I am sorry to say you have to prepare for the worst. In most case, you will not allow to get i-EAD before 90 days of renewal. I think the link is a rare and lucky exception. I ran into the same situation and found that most people did not get iEAD before 90 days. You may be frustrated if you try especially in busy application support centers.

You cannot work after july 7 if you do not have EAD. The only way most operable is to take a unpay leave. take your vacation and arrange the company pay you as bonus etc. until you get EAD. I do think you would be very lucky to get EAD in less than 1.5 months. Read more thread in this board, there are a lot of info.

Anyway I got my EAD renewal in less than 2 month, barely escape unscathed.
