6 Month Vacation

Hello,
I am going to apply for I140 and I485.

In my biographic information I have a gap of 6 months. My lawyer told me to mention that I was on vacation for 6 months (Vacation without Pay). My employer is not ready to support me for that period. My experience letter shows instead of a start date of April 2001 it says October 2001 till current.

Is this a valid reason? 6 months vacation without pay.

please let me know. I am really depressed.

You need to work 183 days a year to remain on H1b visa.

So you can remain on vacation as many as 182 days in a year, but still you need to show salary slips for those many days (no earning etc but employer was generating salary slip for you).
 
Dont worry there are so many desis around with the similar situation and got gc.

Jharkhandi: Is that 183 days a published rule ?
if he has been working w/o gap since his last entry to US that old gap shouldnt be a problem and CIS is unlikely to look that far into past ? they normally ask for past 2 years of W2s/pay stubs. any thoughts on this ?
 
I dont have any Gap in my pay checks since October 2001 - till date .

I came into this country on April 1st 2001.

Any comments.
