5 year residency requirement

Hi everyone,

I have a question, I hope someone can help me with it. I got my GC in 1998 i was still going to college, in my country of origin, at the time. I finished college in 2000. Then I worked in my country until 2003 when I decided to come and live in the US. Thoughout this time ( 1998-2003) i was going back and forth, i used to come once a year ( i never stayed outside the US for more than a year), between by country of origin and the US. Does any of this time count for the 5 year residency requirement? I've been in the US for 18 months now?

Thanks in advance for any assistance

Gus

You should be in the country for atleast 30 months and also maintain continuous residence - No absence for longer than 6 months in the last five years . Also please check if you are eligible for the 4 years + 1 day rule .
The naturalization guide has an eligibility worksheet that you could use to check your eligibility .

Has your wife received any response from BCIS about her citizenship aplication? I remeber, she didn't get an inmediate aproval.

My wife is in a similar situation. The last trip she took out of the USA lasted 2 years and 2 months. She came back on re-entry permit.

Please, let me know.
Thank you.

I recommend you apply a MINIMUM of 4 years + 1 day after you last came back. The best ofcourse would be a full 5 years

Lexmark,
No , She did not get any response from the INS . I think any response we get from now on has to come from the local office . She took an infopass appointment yesterday and enquired about how long the case would take .
The reponse she got was "A WHILE" .
I am not sure what to do now . Is the only thing we can do is wait for the local office to give us a response . If we are not sure I how long it would take , I would rather withdraw the application and just apply again .
Any suggestions ?

What's "4 years + 1 day rule " ? Can you please post detailed info or web link regarding this?

I am pretty sure I have read in this forum a case where the application was denied because the applicant though it was rigth applying 4 years + 1 day after coming back. That person, applied later after five years and got approved.

I think I saved this case in my computer. I will look at it.

However, you wife hasn't received any response. "Hope is the last thing we loose".

Good Luck.
