I have a unique situation and was wondering if you could guide me.
I got my GC through employment and this month I became a US citizen. Now I want to file I-485 for my wife who is in US through her own legal status based on employment.
Six months ago my wife filed for I-140 and I-485 based on her employment(EB3) and has now an A number from that. But she is still waiting for both I-140 and I-485 approval.
I had filed I-130 for my wife when I was an LPR and got the approval too.
Now my question is which is the best way to approach to get fast results for her:
1. will it be okay to file a fresh I-485 for my wife based on marriage to US citizen?
2. is it legal to have two I-485 processed concurrently , one based on marriage to US citizen and one based on employment?
3. should my wife mention the A number (from her employment based 485) in her new marriage based 485 application?
4. when do we need to withdraw the employment based 485 so that her legal status in US is not jeopardized in any way? at the time of her interview or earlier?
5. Do we need write a covering letter explaining such to the USCIS while submitting her 485 docs?
