485 RFE received

ok gurus, i got what looks like a pretty standard 485 RFE.

1. Need a completed G-325A form
2. Employement history in the US since the day I landed here
3. Employment verification letter

Has anybody got a similar RFE recently, has responded and got approved? How long did it take for the approval after sending in the RFE? Any tips on responding to these will help...

can u outline the exact rfe u got? they didnt ask for my legal status or passport copy...only employment history...

also how did u respond? what are the docs u included?

have been here almost 8 yrs
 
Below was my RFE :
a) Copy of applicant Passport, current and expired Visas, and pages with relevant entry of departure stamps.
b) Photocopy(front and back) of the applicants I-94.
c) Photocopy of the form I-797 Approval Notices for all extension and change of status.


What about yours?

they didnt ask me for passport, visas, I-94...for me they are asking employment history like w2, paystubs, tax returns etc...

Here is the exact statement:

"Submit a list describing your employment history since your last lawful admission to the US"

So the way I interpret it is, I went for a vacation last dec and entered US at the end of dec. so I have to show employment history for the last 8 months. Not from day one right?

appreciate all you guys/gurus comments?
 
I am no expert but I would interpret it same as you. Else they would have stated all document from the first time you entered US. I think they want to make sure that you are still employed. Your attorney would probably know better as he must have handled queries like these.

----------------- You were supposed to send G325A when you filed I-485. Did you or your lawyer have not sent G325 at the time of filing I-485? G325A goes different agencies for background check. G325A is very imp form to submit
2. Employement history in the US since the day I landed here
--------------did you change employer after filing I-485? have you been out of status before filing I-485? have you been on Bench?table in past? did you enter US after Bench/table got new I-94 and then filed I-485?
3. Employment verification letter
-----------was that letter not attached with I-485? or you changed employer after filing I-485. if Yes did you sent request to invoke AC21
** when filed I-485 did you sent copy of your passport pages that has you name, DOB all the Visa stamps and US entry stamps?
In past was your any US employer investigated for fraud or H1 violations? Did anybody file complaint against your present or past employer with DOL to recover the past wages?

thanks for the detailed info...now u scared me :-(

yes my packet was complete with G-325A form and all the docs you mentioned regarding 485. yes i did invoke AC21 twice and yes each time i sent all the docs to USCIS regarding it. i have never been on bench or outof status.

ok so now should i sent the whole gamut of docs again or just from last entry in US?

They have asked:
1. Need a completed G-325A form
2. Employement history in the US since the day I landed here
3. Employment verification letter
you need to send what is asked in RFE. FYI if the lawyer or you sent G325 then you or lawyer may have to copy of G325 and ifo on G325 should match with info as on past G325 like your name, DOB, Father name , Mother name Place of birth
for 3. you need to send permanent job offer letter of your present employer with same/similar job duties ( if you also attach copy of latest 2-3 pay stubs that will not hurt)

i think i miss typed 2. this is what the exact rfe for point 2. is:

"Submit a list describing your employment history since your last lawful admission to the US"

It does not say since I landed here. So should I send them everything from the point of my entry in the US last december, when I went on vacation? OR from the date I filed my 485?

--------------------date of your last lawfull admission to the the US is December and list the employment history from the date of entry in december, sign the letter with name, DOB, I-94#, POE name and then list history

OR from the date I filed my 485?
