485 RFE : Employment verification

hi,
I have recived an RFE for the Employment verfication, Will it be a problem if the salary is higher than the projected salary in labor ? Do I need to show salary from W2 or salary in laor application. This is for current employment verification letter.

This is what RFE says

" Please submit current employment letter from your petioning employer outlining your specific job responsibilities in detail, salary, and prospect of future employment. The letter must be signed , dated, and on a company letterhead. "

I dont think there will be any problem if your salary is higher than what mentioned in the labor certification. I have seen many ppl here with salary almost double than what mentioned in the labor and they got approved. My salary is also almost double than what is mentioned in labor. The one thing which is important is that the work/job should be same n similar to what it is mentioned in labor certification.

for the response, I have asked my employer to show exactly the same amount mentioned in the labor. Hope they won't ask for W2. to verify the salary

I wouldn't do that. It would amount to fraud. Just put whatever you are making. Shouldn't be a problem.

i too got similar RFE, salarty won't matter. so keep whatever u are earning. did u get the original RFE mail from TSC? mine is still missing some where. but my attorney is replying to it based on fax version that I recd. from TSC.

same here sree, still dont know the RFE after more than 2 months now...sent 3 letters to USCIS, 3 Faxes to USCIS (giving my efax # in it). Talked to my congress man and initiated the enquiry. I also talked with USCIS 1800 # with several reps. (1 and 2nd level). Finally my lawer is doing AC21 without RFE but lets see if that sufficies the RFE requirement.

i am sorry to hear about your case. that's just too much from TSC. keep trying and keep all proofs that you tried to know RFE where abouts.

There won't be any problem if present salary is morethan that mentioned in labor cert.

Two different concepts plays role here....

one is....It is much safe if your salary is 10% raise/year since your PD....
If raise is 20% raise/year, still it is safe and could be legally possible....

second thing is.....place of employment....

It could be arguable with USCIS if your place of employment changes from low capita personal income state to higher income state....

for example....your labor says that your employment will be in AR, but currently you are working in DC or NY area....you can show your salary raise safely....
