485- RFE AC21 case. Please read, your view is appreciated.

For primary applicant : Letter from current employer, last 2 years W2, last 2 months pay stubs, last 2 years income tax returns

and Medical for both.

Recently I resigned from current employer (who filed GC) and joining new one by next week. Done with all other formalities but joining date in in next week.

Will it be a problem? Will new company give the letter I need with hiring date, duties description, salary and prospect of continued employment?

Going to talk to very good attorney for AC21. Because my case is complicated. I switched job in 2003 and got laid off because of merging with another company. Then joined the previous employer (who filed GC) and now got permanent offer with very good company with rate specified in Labor so already resigned from current one and will join new one by next week.

Please share your experience / suggestions.

I am not an expert on AC21. But in my opinion, your case is not as complicated as you think. Since they are only asking for last 2 months paystubs. With the last 2 years w2 the gap in between jobs may not be that evident.

Your new company's lawyers can prepare an AC21 letter with supporting documents. that should be it. what do others in the forum think.
 
W2 is the problem here..

Because for 2003, I have 2 W2 and that will show that I already changed employer in 2003 and then went back to previous one and again changing to new one. Frequent job changes are my worries.

My lawyer is really good. Going to talk to her today, let me see what she has to say.

One of my family member suggested that instead of filing AC21, just send the papers they have asked for. Is it possible? Has anyone done so?
