485 Question

Hello all,

I have a situation and need some info. Filed for 140 + 485 through company A. 140 is NOT approved yet (180 days on 485 completed), so I can't use AC21. However, I have an offer with company B with approved labor from company B. I am accepting the offer.

So, to file for 140 + 485 with new company, what is the procedure? Do we need to withdraw old applications. My understanding is I can 2 140's, but not more than 485. Is there a way for me to keep my 485 priority date? Any advice is greatly appreciated.

Negotiate with company A to not withdraw 140. Approvals are around the corner. As soon as 140 is approved you can switch under AC21.
 
I really hope that 140 approvals are happening. But in CA, only 29 approvals in last 30 days. Almost all of them had RFE before. Unfortunately, our co. is not doing well. So, time is not on my side. Time to move on.

However, I am fortunate to get an approved labor from my new employee. My question is how does it impact my existing application? Can I use any of it?

Help Please

Can I file a new 485 with company B while 485 in company A is pending (same service center)? Can I retain my 485 priority date? Please suggest.

I think you should be able to keep your PD, but that is stepping on a slippery slope. Is it that difficult for you to negotiate with Company A to not withdraw your 140?
 
No, I think the company A will keep my 140 going. But these days everyone is getting a query about company's financial situation and company A is not doing well at all. So, I really don't have hopes.
