*** 485 pending since 11/02 is H-1B amendment needed for salary increase ***

My 485 has been pending since 11/02 and recently I got a salary increase and the lawyer is saying that she wants to file a H-1B amendment for the salary increase. Should one do that? Any laws you are aware of? Anyone in a similar situation? ANy thoughts appericiated?

there rarely is an amendment filed for salary increase, as the requirement is to pay at least the amount on LCA for H1. The only time i have really heard of amendment being filed if when salary drops below LCA.

r u supposed to pay for the new H1 or the company.
 
Thank-you for your reply....I am actually staying in the same company and not joining another company. I just recently got an increase and the lawyer informed me that I might have to file an ammendment.
 
For salary increase for H1 no amendment is required .... You should get atleast whats written in your H1 Labor .. we all have got salary hiked but never filed H1 amendment for it ... i think whole forum will agree on this ... else the USCIS will be flooded with the H1 amendment cases ....

Take it easy looks like your attorney wants to make some few bucks :D
