485 pending for 3 years,talked to an immi officer today

He told me ," you case is on hold, pending investigation".
My receipt date is June 4th,2003. I am considering filing Writ of Mandamus,
but I have only made several enquries through USCIS and they all came back as "pending security check", should I contact congress or FBI first? I am in MA.
Can I file writ of mandamus by myself?

Try to contact your senator first just to present more evidence that you've exhausted all your options.

Yes, you can do it yourself. I'm doing it with the attorney but she's SO not in a hurry, that I regret not doing everything myself.

Same kinda boat .... I am giving USCIS a lil time till July 2006, if its not done.. I will Attack em ... contacted Conressman in 2004 and not much happened since then ... I will contact em again this month .. after that will file it myself. Cant afford attorney
 
Massachusetts. My attorney really screwed things up, she was supposed to file it a month ago, but only did it June 5. I don't even know if she served summons yet.

Hi Mette..I am from Massachusetts too. I am looking to go down the same route as you. I cannot afford to wait anymore..

Did you file a FIOPA before filing the "Writ of Mandamus"? What procedure are you following to do this? I am also deciding whether to have my lawyer file this or if I should do it by myself (I think I will have to pay for it even if my lawyer did it for me..so dont see the point in engaging that lawyer)

Who is this lawyer who got convcited?? I have heard some real horror stories, clients being punished for lawyers mistakes. Share the name of this lawyer. A friend of mine has gone through similar thing in virginia.
 
WOW Zkhan ..... I am not sure If I should mention the name. However I can give leads.

Imost likely its the same Layer. ( Not many was convicted I hope )

The current Lawyer who took over the cases, informed me that almost 99% of the effected cases are taken care of. All that USCIS wanted was proof that the case was currectly originated by the employers and not created by that lawyer himself to sell the labour . ... Send me a PM if you want to share personal info.

Angela - I am in MA too, and my wife's case was filed in June 2003 as well. Can you please share the lawyer's info? I think I need to do something about it too!

Feel so sorry about your situation. I'm sure things will work out soon. Hope you dont mind answering a question. What happens to spouse visa status after principal's GC get approved?

I got approval just two days back. Waiting for spouse approval.

I485 RD Aug, 05 AD Jun 06

Spouse had LUD in May, 06 but did not get approval. I had no LUDs until the approval. My spouse is going to use EAD from next month, so was just concerned about visa status. How do you maintain legal status? Just keep extending the EAD?
 
Looks like a lot of people here are from MA. Me too. Waiting for Naming Check for two years. AOS still pending. Any one have any experience asking MA congressman's help? or the two senators?
 
Me too, from MA. Does anybody knows why USCIS is showing LUDs on already approved cases?
My I-765 approved in 11APR06 got new LUDs now on 11, 13, 15JUL06.

I live 5 miles away, outside his District. They gonna help me out if I send them a letter or it will be a waste of time?

I`m tinking about file WOM and I need first get a FOIPA results. I know u did this b4. Can u, pls, help me out with this issue? Some attach/sample letter, whatever u think is usefull. I will be greatly apreciated. Thanxs! :cool:
