485 NOID ,212 (d)(3)(a/b) waiver

my Case has been approved on 03/05/03.
I think if I-94 Expires and you have a valid H1 , then it is not a big problem.

Green Card denied and Barred for 3 years

Hello,

I got my GC denied last week and also have been barred from entering the US for 3 years.

All of this is because i didn't renew my I94 in time. In my case, i asked my lawyer for I94 renewal. Shtoe told me at that time, i don't need a renewal as i had other H1-B and I-94 card with it.

Later while applying for 485, she filed with expired I94 (controlling) . I asked her if i can travel with AP if my I94 is expired for more than 6 months. She told me i can.

I have all the email communications with my lawyer. She is Board Certified in Immigration. Can i appeal saying that all the problems were caused by the bad advice from my lawyer. I have the proof of it in my email.

Any suggestions?
