Hi All,

I would like some information from people who have filed
I-1485 petition for their spouses along with application
for self.

1. When you apply 485 for spouse, does the marriage needs
to be registered in U.S. after a person gets married abroad?

2. Is the marriage certificate from India/Canada acceptable?

3. What is the process to get a marriage certificate in India?Canada?

4. What is the process to register the marriage in U.S?

Any other advise on the do's and dont's of this process?

1. Marriage does not need to be registered in US. However you should have a marriage certificate from where ever you got married.
2. Yes. as long as it is a valid one. (There are different rules as to what can be acceptable depending on your religion - eg. Hindus - need to get a certificate from a Govt. ; Christians - the one given from the church will be deemed valid.)
3. In India you have to register you marriage with the registrar. You and your would be have to do some application and then there is about a 30 day waiting period before you can do a registered marriage(civil) Canada - I have no clue but something in the similar lines I would suppose. Its kinda the same with US govt. (dont know about the waiting period - if any)
4. Call up your town clerk and inquire. You may also ask your married american friends - if any.

Does that mean that if I get married in Feb, I would have to wait for 30 days so as to get a marriage certificate from India? .. That seems like a long time .. not surprising though if you consider the way the govt machinery works back at home !! .. Is there any way to get this speedily? ... I am asking this caus I want to attach the spouse petition to my 485 process ASAP... is there a work around like a marriage affidavit? ....

. No. you miss understood me. You need a marriage certificate. It can be obtained from the district/city registrars office. Generally to get this(or to do a civil marriage) you have to fill some kind of application at least 30 days prior to your civil marriage. The case may be different if you got married already and show proof of marriage(I am not very sure of this). So if you are planning to get married in Feb... fill the application and submit it sometime in Dec/Jan. You will thus save the time. OR take a risk, round up some influencial people and go to the registrars office the day after marriage and get it. There people who had done this.

2. This is what I understand from your post.
You are planning to file 485 and want to file for you spouse as well. If this true then...
You cannot file for your spouse since you are not married yet. You have two options.
A. Go ahead and file your 485 (as to not waste any time) then follow up with the application for your spouse once you are married. You can file a 485 for your spouse as long as your case has not been adjuticated.
B. Wait to file your 485 until after you are married and then file together.

Both have its own risk factors. Consider which one you can afford to take. My choice would be option A since 485s take around 1year.

And btw no workaround affidavits for marriage - at least not one that I am aware off.

If you are from Bombay ask one of your relative to collect the form from Bandra Court Marriage beureau, Fill up the necessary form and submit it.

You should get your marriage certificate registered within a day or two.

I already filed for my 485 this month, thanks for the message .. I also feel that the 485 will take atleast 10-12 months ... I hope I am right !! :) ... by the looks of it the 485 filed in Nov 01 are being approved now .... have you ever heard about a case where the 485 has been approved in less than that time?
 
Check the Indian consulate website

If you are married but do not have any document from India, You can get the 'Marriage certificate' from Indian Consulates in US. Check their website and look under Miscellaneous Services.

I believe that certificate should be acceptable.

I am not married yet, I plan to in Feb .. but tell me what is the procedure to get the certificate from the consulate? ... what document would the consulate need to issue a certificate? and is this certificate acceptable? ....

I just want to have all the options beforehand .. just in case my India trip is a really short and rushy ....

You can also call them. They are very responsive.

The process of getting your marraige registered in Mumbai is as follows. I believe it will be true in other parts of India as well

1. After the marraige, fill in a form at the registrar of Marraiges. Both you and your spouse will have to sign the form and present yourselves in person. There is a nominal fee to pay.

It does not matter if you have been married for 1 year, 1 month or 1 day.

2. Along with the form submit a proof of marraige. This proof can be in the form of wedding invitation card, marraige photographs

3. You will also need to have 2 or 3 adult witnesses to the marraige. Parents are the best witnesses, but close friends will also do

4. Everyone will need to present an identification. Passport and ration cards are the best. I got away showing the drivers license, but officer was not very happy about that.

5. Return the next day to collect the certificate. If you have some connections, you can get it in a couple of hours.

I am not sure about the 30-day wait. I never heard about that. So may be others can educate me in that.

Obtaining certificate from Consulate in US

SOrry for the delay in responding. It would be ideal to get the original marriage certificate from India. I believe it may be easy from any place in India. Your friends in India may be able to help you with this one.

If you are unsuccesful in obtaining in India, you may apply for it in USA using the Misc form. Just make sure that your wife's passport contains your name under 'Name of Spouse' (appears on the last page of the passport).
