485 JIT date & AP question

Guys,

Assuming that the 485 JIT date is correct and is not a typo, [optimistic hope & expectation :)] , what date ND or RD, do you compare with this JIT date.

Mine is a borderline case with RD 12/13 and ND 12/17.

Also, my AP expires on 12/30 and I have to travel abroad early next year. Do you think I should go ahead and apply for my second AP now, in spite of this JIT date move??

I understand that this is more expense and hassle.

Despite that, my personal opinion is: yes, go ahead and apply.
Better to be safe than sorry, especially when dealing with a totally unpredictable entity.

You are absolutely correct. The organisation and its process have become very much unpredictable. I was on a dilemma whether to spend again for AP but I guess I have to do that.

I have to get my second FP and then approval, if no RFE got raised. Do you know, if we get approval, how long can we wait before stamping? I have this doubt because, what if we get the approval when we are abroad with our AP?

At least 1 RFE will be raised stating that EVL is older than 1 year.
Also, no approval is possible till 2nd FP if your first is expired.

I think you should be OK, based on when your FP notice / RFE arrives. Do FP first, then reply to RFE after 2-3 weeks.

In any case, an approval can happen when you are away on AP. You can reenter and get PP stamped.

I'm not sure if there is a specified time limit for stamping; I should think within 90 days (guesstimate) should not be a problem. Try checking with a lawyer.
