485 from service centers

Hi,

I have couple of questions on AC21 and moving to different service centers.

I have applied for my 485 in TSC and after 180 in the job, I have moved to California. I got married after that and got my wife here on H-4. My lawyer suggested that I should apply for her 485 in California service center. So I applied for her 485 in CSC.

Now, I have to change my job again and I need to move to Virginia and which is under VSC.

Are there any problems in using AC21 twice for me?
Would be there any problems for my wife's approval?
Are there any issues I should worry about?

thanks

--- That was correct your file I-485 will be attached your I-485 pending file in TSC

----- No problem, better update the service centre before I-485 approval that you have changed intent and send AC21 letter with letter from new employer for future permanent job
Would be there any problems for my wife's approval?
----- No
Are there any issues I should worry about?
---- USCIS is lazy to attach the correspondence with pending files you may get RFE before I-485 approval and you may have to again submit new employer letter. Don’t forget to file change of address form for you and your wife when you move (form AR11) and update the TSC by sending copies of pending I-485 receipts that your address should be changed write in the cover letter your A# name, DOB, pending I-485 # and your wife Name A#, DOB, copy of I-485 receipt, provide your past address and new address and send it to TSC with certified return receipt and also write out side the envelope: Attention: Change of address on pending I-485
You should also change the address with NCSC on phone # 1-800 375 5283 and provide the past and new address and I-485 receipt# of you and your wife.

** If any other application/petition is pending then write in the cover letter to change the address for all pending application for you and your wife. You may have to get EAD and AP from TSC service center in future

* i dont see any problem if your I-140 is approved and I-485 pending more than 180 days and same/similar job to use AC21

thanks ginnu

thanks ginnu.

My 485 application is in TSC whereas my wife's application is in CSC.

Do you think that would cause any delay or any problem for my wife's approval? I am done with my FP whereas she is not.

thanks

My 485 applications is in TSC whereas my wife's application is in CSC.

----- Your lawyer did a mistake, generally your spouse derivative I-485 should be filed with the same service center where your I-485 is pending and should be interfiled with your I-485 pending file.

It may delay and complicate because CSC may have to send your wife I-485 files to TSC or CSC may ask principal applicant I-485 transferred to CSC. Lawyer did a mistake according to me and it will delay the processing of your wife I-485
