Hi everyone,
I have a very specific question.
I am currently on F1 visa (OPT) and applying for H1 on April 1st. I have MS degree from US university but I don't know if I will get H1 due to the recent rush and cap problems. I want to apply for 485 to get my EAD before my OPT runs out (if I don't get H1)
Here is my problem:
My wife is currently out of the country.
She will come here for 1 week on L1 visa for a business trip. Can we apply for 485/EAD/AP when she is here?
Q1: If she applys for 485 now on L1 status, can she enter US later on with any other status? (Like H4 in October if I get H1)
Q2: If she applys for 485 now on L1 status, can she enter US with her advanced parole (with no status)? (assuming I don't get H1 and she can not come back on L1 either)
Would you please give comment about it.
