Hi,

My husband who is primary applicant recieved his greencard in Sep 2007.I have applied my 485 in Aug 13 '07.Does my case depend on priority date or processing date(Texas processing center).I called USCIS couple of times and they told me that my application now depends on processing date not on priority date.Is this true?

Not if they are from retrogressed country. Then it all depends on Priority date.

I am from EB3-India and my priority date is way back.

We are in the same situation now. My GC was approved in Sep 07, and my wife's application was submitted on July 07. Haven't heard anything on her case yet. I think it depends on the priority date of the primary applicant. We are EB3-India as well, with priority date of Aug 02.

Then I have long way to go..my priority date is nov 02.I called couple of lawyers who come on Radio show, they told it depends on priority date,but USCIS representative tell that it depends on processing date,this system is so confusing.

FYI, even for retrogressed countries, there is PD. It is just that the PD is not enforced for those countries.
