485 divorce questions

Hoping for some responses from some old veterans on the forum (Realcanadian, Jack etc) on this situation :

I am on H1-B and wife came here on H-4. I applied for I-485 adjustment of status for myself and wife.
Both of us have EAD and AP. Things may not work out. If we go thru a divorce, can I bring another immigrant wife on H-4 in the future ? I am absolutely sure I will have get my attorney to revoke my wife's 485 application. Otherwise the American Embassy may not issue a visa (in the future if I get married again). I am in the ROW category in EB3. Last question, if possible to bring another H4 immigrant wife, I wont be able to file her AOS, since the PD's are not current. If I get the green card approved, what would be her status ? how could she legally stay in the country being my dependent ?

have you been able to keep your H1 status alive by renewing it every year? or did you give up after recieving your EAD? If you have your h1 alive, than no problem at all and you can get married again and bring your new wife on H4. and if your I485 is not approved by then, you can include her in your applicaion along with a divorce certificate. If you dont have H1B active right now, than things are a bit complicated for you. someone else can shed light..

Sure.

You cannot have your attorney withdraw your wife's I-485; only her attorney can based on her instructions, not yours.

That's correct.

You seem to be in an awful hurry to replace your wife.
 
I have known of cases like your own where INS continue to process spouse green card once I-485 was filed .So there is very little you can do to stop it at this time. There are also other cases where the dependent spouse whose I-485 was already filed when she seperated from her husband made allegations of being a victim of domestic abuse. She was allowed to remain inUS until her green card was issued. Husband went to INS and informed them of divorce. But they said there is nothing they can do.

RealCanadian / Tola : Thanks, It is true that when you are miserable you try to get your significant other out of your life (as bad as that sounds, it is true). Ofcourse no harm in figuring out your options. Thanks for the feedback.
 
follow "subzi mundi" owner's process, all the veteran ladies working in subzi mundi are owner's wives, he used law to the extent and better stop seeing the lawyer and contact subzi mundi oak tree road.

If our spouse can keep up thier i485 and stay in US after divorce, how long we need to pay alimony?

I was married for 10 years, we were in India for 7 years and 3 years in US. She never worked, always been dependent on me.

Now do I need to pay alimony for half of marrige period (half of 10 yrs -> 5 years) or for the time spent in US only (3 years -> 1.5 yrs)

well if you've called them then ask them this question, they know better than anyone here, sometimes the operators are not helpful at all so you can make an InfoPass appointment, this means that you can go to a USCIS local office and speak with an immigration officer. tampa divorce lawyers

I am sure you must have tried your best to protect your marriage.But now after 10 years of marriage when you are bent upon to divorce ,at least give her GC. You want to snatch GC from her hand just for replacing your future wife . Come on man come on. Let new wife come with her own visa may be L1,B1,H1 and get her GC or who knows new wife may be GC/H1b holder.
I am guessing that you may have kids too if that being the case wait for GC to be over. I know a similar case where pushed to corner , wife approached USCIS and alleged domestic violence. You may be surprised by result of her going to USCIS . Give some thing to your ex wife for being your wife for 10 years.All H4 wife deserve at least some reward for going through a boring life in US .

I agree with victim_of_INS that wife deserve green card for spending boring life as H4 and for facing domestic abuse.Nabeel1 please chage man and wait till she gets her GC.
