485 Denials

What is going on? Before around 1 year, I did not see a single denial. I had even heard denial is a very very rare thing to happen. I have also heard that in a long history that there has been only a few denials and most of them eventually got approved.


WHAT IS GOING ON THESE DAYS? I see denial like crazy these days. It seem so many people are talking about denials these days. Has there been new laws or something? How come we are hearing about so many denials these days?

renew EAD

VSC denied my I485, I sent an MTR two weeks ago. Because my EAD will expire soon, I have to send application to renew EAD. Do you think VSC will deny my EAD immediately or just wait for some days? Can I get EAC number? Someone told me VSC will check I485 status first and then they will make a decision to send an EAC number or not. Is it true?

My 485 Has been denied. MTR has been send as of 23rd March. Have not heard from them about MTR of 485 since then. NO LUD's.

You should apply the EAD immediately no matter what. Thats what I did. You will get a EAC number even though your 485 is denied. I applied my EAD renewal too after my 485 denial. I got a EAC number. I just hope they re-open my case AND THEN process my EAD.

May I know what is the reason for denial? I-140 revoked?
 
Well most of the cases that i have seen in the db, 485 denied because 140 is revoked. Make sure your employer did not mess up the 140. Even if he did, you can still file for AC-21 if you are with different employer. CIS may ask you more details on the new job but your case will continue. Other case i saw is any criminal case or registered SO
 
But for 140 revoked with AC21 applicability cases (140 approved and 485 pending more than 180days) i guess they will send a NOID and ask for more info. Not sure if it will be a straight denial.
 
VSC changed policy?

VSC denied my I485 because I140 is revoked, even though I140 approved and 485 pending more than 180 days. VSC never send a NOID, just straight denial. I don’t understand why they did not follow the rules that they established.
