Folks:

A friend of mine has applied for I485 in April 23th in VSC and his company is closing down.

His GC approval may be coming soon.(I saw some posts regarding approval for March RDs).

Does he need to be in similar job at the time of approval? I am not sure whether he can get it in this tight labor market in 2-3 week time frame.

Any body in similar situation. Please share your experience.

Any suggestion is welcome.

Thanks

If the company knows it is closing down it would be fraudulent for the company to say that they inte

He needs a similar position or the AOS will probably be denied

Not having a job causes questions regarding how the person will avoid becoming a public charge. Not to mention that for an employment based GC to be approved there must be employment.

Is INS going to find out the company has closed down? Do you think that company will notify the INS? My friend is also having the same problem. But he managed to find a job with different job title. From software engineer to Web site developer (using EAD card.) In the mean time, he is also looking for job with similar job responsiblities and title. His salary is so much lesser than his previous job but it\'s the same as the salary stated in LC. Will he be in trouble if he receives RFE regarding employment letter, pay stubs?

Thanks.

Maybe

If INS schedules an interview they could easily ask about this type of thing (corporate closings). You would then be in a bad position, if you\'re asked directly by an immigration officer if you knew the company was closing down when you got the letter, you would have to say yes since a false statement under those situations is immigration fraud and could cause revocation of your GC (if it was already issued) or even citizenship if it was discovered after you were naturalized (but I\'m getting ahead of myself here).

As someone once said, "no immigration situation is so bad that it cannot be made worse by lying about it."

Thanks for the responses.
Is it not possible to explain the situation to the interviewing officer?

How many percent of total applicants get interview notice? Any thoughts...

Thanks again.
