Hi,
I-485 application filed on my wife's behalf was approved while she was abroad.
I (for myself and my wife) recieved Approval notices
for (I-797 C Permanent resident Status) on 17-FEB-05
after my wife travelled to India on Advance Parole/EAD while I am in the USA.
My wife is scheduled to return to US on 20-MAR-05.
I took the Infopass appointment for stamping my passport with I-551 on 03-MAR-05.
My attoney recommends forwarding the I-485 approval notice to my wife, so that she can show to the CIS officer at the port of entry
so that the immigration officer can adit process my wifes passport and stamp it or parole her into the U.S on officers choice at the port of entry.
We now have two options.
1)My wife comes back to the USA on Advance Parole without showing the CIS officer the I-485 approval notice at the port of entry.
Then she goes to the local office and obtain the I-551 stamp in her passport.
2)My wife comes back to the USA on approved I-485 by showing the CIS officer the I-485 approval notice at the port of entry.
Then Immigration officer places the I-551 stamp in her passport.

What are the advantages and disadvatages of the above two options.

With option 2,can the immigration officer at the port of entry order
the plastic card for my wife after stamping her passport.

Thanks in advance you for your help

try to help you

I think it is better to just let her use AP to enter to avoid unnecessary trouble that may come.

Thank you Little Cat.
But my Attrorney recommends sending the I-485 Approval Notice to my wife.
Is there a problem if the Immigration officer at the Port of Entry sees the I-485 approval notice as she travelled on AP.
Please inform

Sending her the approval notice is not needed. Even if she has the approval notice, as long as she has valid AP, she should have no trouble. If the POE officer asks about the 485 approval notice, she should tell the truth that her husband send it to her incase she needed to show it at POE. No problems with that.

Thank You Jllag1.
But I dont know why my attorney instructs me to send the I-485 Approval notice to my wife.

Maybe he just wants to cover all bases, who knows? If you do decide to send her the approval notice, send her a copy. You do not want to loose her original before her passport stamping.
