485 and Marriage

Hi people,

Current Status: On H1 B
GC: 140 approved, received RFE for 485 (paystubs etc)

Got married earlier this week, but sadly the consulate here is all booked, so cant get an appointment for my spouse. The next available date in the consulate here (Delhi, India) is July 20. The last date to reply to my RFE is 7th July.

If before she can take the interview @ the consulate (or before she can have her follow 2 join application submitted), if my GC is approved (I cant delay the response to RFE beyond July 7), what are her options?

What if she gets to US before my GC is approved (on H4), but her medicals/other stuff takes time, and in the meanwhile, my 485 is approved? She will be out of status immediately, what are her options then?

Needless to say, we are all having sleepless nights, and are quite nervous:

----- let the lawyer mail the RFE on 5th july and let your wife go for Visa stamping on July 20,if she gets H4 Visa let her fly to US next day and keep her I-485 filing papers ready, find out the doctor who can give Medical results in 1-2 days then just attach copy of her I-94(both sides, get her photographs( you can get in 1 hour) ask her to bring her birth certificate copy or 2 affidevits and non avalibility certificate if she does not have BC and be ready to mail the I-485 after she arrives ASAP becase once RFE is replied they may take 1-20 days to again touch your I-485 file. you have to take a chance filing her I-485 ASAP after she arrives

--Pray that your I-485 does not get approved before she enters on H4 and talk to doctors who can do medical ASAP
