if i apply for my 485 now and get married later, how risky is it? can i delay fingerprinting? if so for how long? can i ignore the first notice completely or i have to re-schedule. i have heard you cant reschedule for more than 3 mnths.

appreciate any responses

thanks,

----- You can apply your I-485, EAD, AP and maintain H1 status (don’t use EAD) bring your wife on H4 and when she reaches US on H4 visa file her I-485 and her I-485 will be attached to your pending I-485. you can send her I-485 ANY time before approval of I-485
can i delay fingerprinting?
----- If you received Fingerprint notice go for it, it does not mean that they are going to approve your I-485 ( I-485 takes 22-28 months at this time0
if so for how long? can i ignore the first notice completely or i have to re-schedule.
---- You can reschedule. But why you want to postpone FP?
I have heard you cant reschedule for more than 3 mnths.

thanks ginnu

so based on the current processing times, it makes sense to just file even if ur not married. but you never know UCIS might just decided to randomly approve cases...

i was wondering how many people on this forum have filed 485 when they were single and how many waited, got married and then filed?

I did.
ND for I485: 3rd week Oct 2001
FP: 2nd week of Dec 2001
Got married: first week of Jan 2002
Wife applied for I485: First week of Feb 2002
My I485 approved: Last week of Feb 2002

Dates were kind of tight.

Her I485 is in backlog. 2nd FP done in Jan 2004.

If you want to be on safe side you can delay your FP. FP results come pretty fast from FBI and USCIS does all the delay in I485 stage. If you delay your FP and USCIS is very slow to process your case, your FP delay is not going to affect your I485 processing time anyway.
Now, if USCIS decides to process your case very fast, in that case FP delay will help you give some time-space to get married. In that case your are delaying your I485 processing. But that's the whole idea, isn't it?
On other other hand, you can go ahead and do FP on schedule. I took that chance and that worked for me very well (in fact if I delayed FP in 2001, probably I still would be waiting for my GC today), but that may not work for everybody.
