485 and Immigration Status

Hi All
 These are my case details. I filed for 485 in aug-99 ID may-96. My H1-B expired on Oct-05 2000. I filed for a extension in sep-2000 (I finished 6 years but I have about a month of H1-B time I could use) but the new approval did not come yet but I have a ID prior to 05-OCT-00 from my extension petition.

My question is, since my I-94 in my passport expired on 05-OCT-00 will I have a status problem. My lawyer thinks I will not but I want to make sure. Any comments will be greatly appreciated.

Stamp on the passport is not important from the status point of view. As long as you have applied for H1 extension you can continue to stay until the time you hear from INS.The problem starts only if H1 gets denied which does not happen normally.

Though,you will not be able to go out of the country and come back without a stamp.
