485 and H4

Gurus!! need some info

Will the consulate issue new H4 for a dependent when 485 has been filed for the principal applicant but still has valid H1 for 1 more yr and is using H1 not EAD ?
 
H4 and 485 seem to be mutually independent. Its upto the H1 holder which option he/she wants to use to re-enter the country.

Some say thats its best to use your present status (usually thats 485) but most people hang on to their H1s just incase some complications happen to their GC process.

So bottomline you should be able to get an H4 as long as your spouse's H1 is valid !

The H-1 is nice since you don't need to worry about renewing the EAD/AP every year. I use a 90-day rule; if I cannot guarantee to myself that I will remain with my H-1 employer 90 days from now, I file EAD.

(Atlanta Local office) EAD was filed in February, approved in April. :)
