485 and 130. Quick Questions

Hello,

I am on H-1B married to US citizen. I am almost ready to mail out my 485/130/765/131/693/864 application.

I will appreciate if you can provide your insight of the following questions.

Q1. Should we remove instruction pages from the forms?

Q2. Do people generally hire attorney for such applications? I am applying on my own.

Q3. I (sponsored immigrant) am including my income/assets with my wife (USC) on I-864. I have filed I-864A. Is that OK?

Q4. I am using a tax transcript from IRS for 2002. (3 years back). IRS faxed me a copy of this transcript? Do you think this is okay since I no longer have a copy of the tax return?

I would like to stay in touch and see how the timeline is going forward for people applying for same situation.

Yes. They don't need instructions.

If your case is straight forward, you can do it by yourself. I did it by myself.

Yes that is fine.

Q. I am applying for EAD(765) so that I no longer have to be bound by current employer (H-1B). In this form, they ask for copy of last EAD. Since I am on H-1B, will this mean - copy of H-1B visa and I-94?

No, EAD means EAD. If you don't have, you don't need to submit one.
 
Hi, my apologies for hijacking this thread, but i am really confused and need some advise.

I am in same situation as twisharad, married a USC in Jan this year. I am on H1 which expires Jun 2006 and im half-way with my forms to file for family based immigration. Here are questions which have me confused...

1. Do i need to file I-131? Cant i use my H1 to travel?

2. Do i need to file I-765? Can i use my H1 to work till i get my green card? Also, if i file I-765, is the EAD needed after i receive the green card?

3. If i feel that i wont get my green card in time before my H1 expires, can i apply for AP and EAD later?

3a. Followup of q3. Instead of AP and EAD, Would it be wiser to apply for H1 extension based on a pending AOS?

4. My USC wife has been unemployed since Aug last year and i plan to use my income and assets for sponsorship. I-864A asks for my 'evidence of income'. Can i use copies of my tax return forms (would copies have to be notarized?) or should i contact IRS to get a copy of my past W2's?

5. Which one is the non immigrant visa number on the visa? the control number or the number printed in red?

6. Since i plan to mail all forms together, should i take the medical exam first or would i be instructed as to when and where to take the exam?

7. Some forms ask for Alien registration number and A#. Where can i get that from? Is that the same as I-94 number?

Sorry if i seem to ask a lot of questions... but answers would be really appreciated. :)

copy of last ead needed for I-765?

Few years ago, when I was on F-1, i had applied successfully for EAD for optional practical training? should i attach copy of that EAD with this I765 form?

Yes, you have to attach that EAD's copy. That is what they are asking for.

Ok - I have 3 more quick questions:)

Q1. At many places, they ask for A# (if any). Since I am on H-1B, I should answer NONE there, right?

Q2. They ask for non-immigrant visa number. What number on my H-1B visa is that? Or is that I-94 number?

Q3. At many places they ask for File Number that is supposed to begin with an "A". I am applying 485/130 concurrently. So what should I put there?
