485-A and 245i submission

Guys, my lawyer is about to submit application for AOS w. 245i based on petition to a parent. My lawyer is pretty good and knows exactly what he is doing. But, i would also like to do my hw and do my research independently to make sure the case proceeds well.

My understanding is the application is filed in Chicago and then is processed to your local field office for interview or CSC. Will the time frame be any different than a regular AOS application?

also, let me know if anyone else has applied or is going thru the same process. The application will be sent sometime later next week.
 
I am petitioning my parents. apparently, then came in via canada 10+years but CIS has no records of entry.. but luckily they qualify for 245i.
 
My apologies to have misled you .. but my parents do qualify for the 245i cause they had applied for labor certification in 1998. They had applied in good faith and therefore qualified for 245i! My concern is only that their PR doesn't get delayed since I want them to have the freedom to go on vacations out the US. Is the time-line similar to a regular 485 application?
 
It seems like you are worrying about something minor that you cannot really change or predict. My speculation is that at most they might scrutinize the legitimacy of the 140 petition but once that's done I don't see why it would move any slower than a normal AOS. But oth you can't really predict at this point how much time and effort they will want to spend attacking the 485-A but if it were me I'd worry more about them arguing the 140 was frivolously filed to take advantage of 245i before it's expiration rather than my parent's vacation plans being jeapordised but that's just me.
 
Thanks for the heads up! I believe the 245i bill wasn't even in the pipes when they filed for labor... so that will be a relief. I'd thought it may take a year just because of the special circumstances.
 
I'm not sure which month your parents filed their labor cert but 245i first became famous in 1998 when it was publicised all over the place and everyone was rushing to file their petitions before it was retired. Same thing happened once again in 2001 when congress extended 245i for the last time before retiring it permanently in May 2001. I know nothing about their labor petition so cannot comment on that but I do know that CIS attacks marriages in 130 petitions and all types of 140 petitions when it comes to 245i benefits if they smell any possibility of a kill.

Anyway my point was that if it were me that's all I'd be worrying about rather than a delay of a few months. There's nothing special about the circumstances here except for a potential weakness CIS may attack but I have no clue whether they have any basis to do so or if they have a chance in hell of succeeding.
 
well.. let me just start the waiting game and see what happens. I'll update this thread w the timeline.
