Hello Guru's,
I had an approved I 140 from MA, then was moved by the company to GA. After coming to GA, they applied for a new labor and... more then 4 years of agony (stuck in BEC), it finally got approved last June.
During the July fiasco they applied 485. Here is the dilemma, they applied for 485 alone, based off of the 140 that was cleared from MA while all along they were talking of parallel 140 and 485 once the new GA labor gets approved.
There after with some great guidance from the guru's on this forum, I got them to apply for a new 140 based on the new labor that was cleared in GA.
Long story short, the situation is that we have 485 applied based on old 140(different state) and 140 applied after applying 485 is going alone on its own. Another twist is that 485 has been filed at NSC and the new 140 at TSC.
According to legal, and this was 6 months back... they think that since USCIS is the one processing both 140 and 485, it should not be a problem...
This is giving me a lot of grief and confusion. Can someone please comment.
Not that I am complaining if it is true, but what if it isn't. What if the lawyer screwed up and I will be left with more grief. I have already been waiting for the past 6 and half years for all this to happen.
