Background of my case:
I have had 2 stampings on my passport already. 1st one in India in March 2001 (for Employer 1) and the 2nd one (for employer 2) through the revalidation process in St. Louis, USA in September 2003.
This is the 3rd Visa stamp (for employer 3) that I would be getting on my passport (I-797 / I-94 valid till 03/17/2008).
My Visa Stamp from my previous employer (Employer 2) is good till Feb 01’2006 on my passport.
I do not have any education in USA. I have a Bachelors degree in Computer Engineering from India. (All my educational certificates were submitted for the first time visa application) and got an Evaluation Report. (A copy of this report I submitted to the subsequent H1 B transfers/stamping as well)
I have 3.5 years work experience in USA
Questions:
I need to know about the 60 days rule: The visa stamp can be renewed within 60 days of its expiry on the Passport. Can I be eligible for stamping after December 3rd, 2005.
Can I go to Canada in December, 2005 and get the 3rd visa stamp without any problems. I have read on some forums that people can get stuck there for some background checks for weeks or months. Is there a slightest chance that I could get stuck in Toronto? (Although I would not be required to travel to India as I have Canadian PR, but any delay in stamping in Toronto would have adverse affect on my available Holidays which I want to spend in India.)
I am planning to go to India in Feb’ 2006 for my marriage and would have to take a H4 visa appointment for my wife in the New Delhi consulate in March. Would it be better I too get my H1 visa stamp there?
In my case, what would be the proof of maintenance of legal status in USA. (W2’s / Pay Stubbs etc). I wasn’t on payroll from Feb 15th, 2005 until April 22nd, 2005. As I was switching company (to employer 3) and went to India on April 24th only to return back on May 22nd on employer 3's new H1B visa. Would this be a concern ?
Please advice in the light of this information, whether I should go to Toronto, Canada in December to get my Visa Stamped while my Visa Stamp on my passport is still valid for another 60 days or should I travel to New Delhi after my visa stamp has expired (Feb 1st). I am about to block the interview dates for Toronto / New Delhi in the next few days.
