My husband is in India and going to the consulate to get his H4 revalidated.
Can you please let me know what his answer should be for question 38

Should he say yes or no for this question as we are applying for consular process and not 485 and our I-140 is approved

Please kindly let me know as we are in a dilema as to what to write

--- it seems to me that LC was filed for YOU and then YOUR employer filed I-140( immigrant Petition )for YOU, if that is true and your Spouse is applying the H4visa stamp then his answer will be NO as no I-140 was filed for HIM
