When does the 30-60-90 day rule apply from to change jobs. Is it from the date of approval of 485 or date of stamping of the PP.

Rgds,

Yeppo

yeppo it is used by Dept of State for consular processing. In case AOS (adjustment of status) whether CIS uses that or not is yet be seen. Even in any case if it is used then it would be from the Approval date.

this is not the rule but it is kind of system developed to predict how serious and faithful the employee is for the employer after getting GC (after consular processing) when he changes his job. In other way to pridict the emplyees intent. They feel that if the employee leaves after 90 days it is very likely that he had good intention to mentain the job with the old employer and if he leaves less than 30 days it predicts that it is very likely that the emplyees intention was not to mentain his old job as promised while applying for the GC. I think it is just the marker for the prediction used for the consular processing, it is not as such law. I also read somewhere in the forum, which I am trying to explain.
