3 yr H1B extension after using Advance Parole

Hi,

Our attorney filed I-140 and I-485 concurrently during Nov 2004, my I-140 was approved sometime in April 2006 under EB2, my priority date is May 2003 and I am completing my 8th year H1B sometime this Nov 2006.

Last week I visited Canada via Buffalo by road, and returned to USA via Buffalo by road, and I used my parole visa to enter into USA as I do not have valid H1B stamping. Before I make a visit to Canada, our company attorney requested me to send the I-94 and the current pay-stubs to file my 3 yr H1B extension. Is it possible to file my H1B extension further after using my parole visa? Thanks for your help.

Srika,

There is no problem to renew H1B after using advance parole as I did already. Just give them the I-94 based on AP.

Srika and hope_Nov,

When you re-entered, at buffalo port of entry did they issue you new I-94 card? How long your newly issued I-94 is valid?

Yes, They issued a new I-94 vaild until Jun 11, 2007 and my date of entry at the port of entry ( Buffalo ) by land was Jun 02, 2006. Thanks.
