3 Years to get to the 485 Interview in NY

General bit of information that may be of use to people about to file in NY.

My wife and I lived in New York and were debating whether or not to move to New Jersey sine NY's filing times seem to be slower. Sadly we stayed in NY... BIG MISTAKE.

I am a citizen, born in the US and my wife is from South America.

We filed in July 2002 and are just now going for our 485 Interview in May 2005!!!! No delays, just the way it is here.

Our friends filed in January in December 2005 and have already completed their interview, passport stamped the same day!!!! No special treatment, just the way it is in NJ.

General message - MOVE TO New Jersey before filing!

Please help give me advice

Please Help: did anyone here file I485 through marriage to US citizen and have their case processing in National Benefits Center? My case has been pending in NBC for one year and 7 months (RD: Oct 2003). Please let me know if you have been waited for that long. I have spent enough money to renew my EAD and AP. Please advice me if I should contact someone to help or not. I did everything by myself and sent thousands of letters inquring the case status to NBC, but never get any reponse. Please advice. I have browsed this website and haven't seen any case like mine been through this long.

so falcryn, did you have your case processed in NBC? Did you receive the interview letter from NBC or from the New York office

Everyone’s I-485 are going to NBC for “pre-processing”, a shorter word for a “stuck in a big pile until they ready to transfer your case to your local District Office for an interview”.
What you should do is to check your DO’s I-485 processing timeline.
Where do you live? Check here: https://egov.immigration.gov/cris/jsps/ptimes.jsp;jsessionid=bt-turl5sZG6 for your DO to see what dates they are working on now

Jane - Thanks so much for replying. The issue is that I moved from Utah to Dallas for almost a year. The NBC never transfers my case to Dallas office. I talked to Utah office, they said I moved, so they don't have my case anymore. I also talked to Dallas office. They also said they don't have my case. So I don't know which office I should check the I-485 processing timeline. Plus, both offices' processing time have passed my I-485 notice date. I worry that NBC skips my case or forgot about it. What should I do?

Yes, you're right, in either office your case should be process by now. :confused:
You did send them (Missouri Service Center – NBC) the letter informing of your new address after you moved?
Your have to contact your local congressmen. Write him/her a letter together with your US citizen spouse. Ask to make a inquiry on your case.
Other than that…. Do you check the status of your application on-line? When was the last time your LUD (last update date) changed? Does your massage still says the usual “We received your application, …. We will mail you a decision as soon as processing is complete”? Or something else? Did you do your fingerprints?

Yes - All my notice receipts came from NBC with the numbers starting with MSC. I have send tons of letters to the Utah office and NBC regarding change of address, but no reponse. I did my finger print a long time ago and the case status hasn't been changed for a year and half saying "we received your finger print.....your case is resumed to process. We will mail you a decision as soon as processing is complete". I guess I really need to contact my congressman. Do you think the congressman are helping? Do they hate people like us bothering them?

Do not worry about silliness like that.
Congressman is an elected government official. Elected by US citizens and his/her job to serve the needs of people who elected them and make the government work better for the people.
They’re getting mails and e-mails, and phone calls every day from people asking them numerous favors and they do listen, because it is their job. And they do help a lot of people with an immigrations issues.
I personally never contacted one, but my friend did and she was very pleased with the results after the congressman involvement. Lot’s of people on this board contacted their congressmen and senators for help as well.
They will make an inquiry and follow ups and keep you informed. Maybe not personally, but they have offices full of staff working for them. Do not be shy to contact your local representative:

Write him or her a nice letter, explain the situation with as many details as you can, include copies of receipts you got from INS and ask them to help you. They have power and sources.
The alternative would be to hire a lawyer and pay him a big $$ for the same thing that congressman will do for you for free as a part of his/her job.
