3 years degree EB3, 140 at NSC - please advice

I have a 3 year bachelors degree (BSC) of Physics from INDIA and have more than 5 years of experience before applying for EB3 labor. My Labor was approved.

Here's what My ETA 750 says "

In column 14 - Bachelor degree
Major field of study- Comp sci,Maths or MIS
Experience -2yrs
Column 15 - Empty

Now, What are the chances/ need to do to my I140 get Approved?

my company's lawyer does not give me proper advice.
Can my I-140 be filed in EB 3 ? Since I have 3 years Bsc (Computer science) what chance would i have if sheila would evaluate my degree as Bachelors ?

Please help

Hi vibrah06,

This is my opinion and experience. My I140 got rejected based on the same wordings ( I have same qualification like urs) "Bachelors" means bachelors degree from USA.

If your LCA says,
a) Euivalent of Bachelors then they consider 4year degree from india.
b) Foreign Equivalent then they consider deriving equivalency by credit hrs.
c) Just Bachelors then they consider bachelors from USA

Comp sci,Maths or MIS...... yrs specialised in Physics....

I dont want to discourage you... but it was my experience.

I have BSC Comp sci and GNIIT, The education evaluation qoutes GNIIT as the credit hours that make up US B.S computer science equivalent. My labor has Bachelors ticked and also the column where it says foriegn equivalent ticked. Is there a good chance of me clearing the I-140.

I have another question. If I file another new labour through perm, Can I keep my old priority date?

Well my I140 got rejected, and my employer is looking for someone who is suitable for that LC So its basically waste for me(4.5years of time wasted due to a unprofessional attorney)

you can start new PERM but cant keep the PD unless the I140 is cleared for your prior LC.

I am not an expert on this matter... I just shared my experience.
It looks like you have fair chances.... provided you have a support of a good attorney and good education evaluation.

So what does it mean? What's the best course of action you recommend for someone with B.Sc(3 years) + MCA(3 years) from India, with a labor approved for EB2.

There was a time when the masters=masters worked. Then it needed to be a 3 year masters = masters to get approved. More recently I have seen a 3 year masters = masters denied. Frankly I did not understand it.
 
Good News - I140 approved

I wish to share the good news that my I-140 got approved today.
I-140 Filed: Sep 12th. Got converted to PP on Nov 20. Approved Dec 12.

I was totally ignorant of the intensity of my case until I visited this forum. I did not know anything about the qual. and experience mentioned in the ETA.

I was too much worried about my qualification and the Col 14 in ETA 750.
I thought I have no chance of getting my I-140 approved and decided that I need to leave the country. But I had high hopes in my prayers which had lifted me upto the current level in my life.

I was so much frustrated that I did not even work of 2 days. But finally the good news not only for me but also those who are in the same boat as me has arrived in the email.

Here is my case details
Col 14: Degree in Computer Science or Related study
Experience : blank
I have : Batchlors in Arts but MCA with tons and tons of experience. Yes I started my carrier as Programmer in 1991. Gone through several stages and technologies in the last decade.

My edu. evaluation mentioned that I have Batchlor of Arts and Master of Science in Computer Science. My attorney said that I don't need to worry about the RFE as I have MCA though the ETA 750 mentioned only batchlors. Until now, I did not believe my attorney because of the practical cases discussed in this forum.

However, friends, please DO NOT loose your heart. Take my case as an example if you have 3 year degree that too in Arts, still you can get your I-140 approved. Believe in prayers and Keep praying.

It appears to me, option#2 could be one of the stones he could throw in the dark. Does it work? Chances are very less. He needs tonnes of luck.

Hope he finds a better option.

I have B.Sc computer Science (3) + M.Sc computer Science (2) years
I am worried after stunpad's post.


I don't know what are the chances.

Could u please elaborate how ur lawyer did the evaluation? I am facing same problem & its urgent.is it course by course or any other method? I am so worried and if u can help me tackle this problem it would be great..

Please dont take my words as granted.... there are people who were successful... with ur qualification and my qualification earlier.. check this forum.

I am trying to share my experience. As I was not aware of this 3year degree issue till my I140 got rejected...

My PD is June 2001 and denied - 3 year degree. Started a fresh PERM labor and PD is February 2006. Wasted valuable 6 years. I'm now 42. I would be 50 when GC is approved or start another labor after 50???
