"10/22/2008: Three-Year TN Update

* AILA has reported that it is the current USCIS practice that those TN applications which were pending before October 16, 2008 will be granted the period of stay which the TN employer asked or maximum one-year, whichever is less, and those applications which have been filed on or after October 16, 2008 will be given the period of stay the TN employer asked or maximum three years, whichever is less. Accordingly, if the employer filed the application before 10/16/2008 seeking less than one-year, the alien will be given a TN status for that period and not one-year which was the maxium under the rule before 10/16/2008. In the same token, if the employer filed the application on or after 10/16/2008 seeking less than three years, i.e. one year, the alien will be given a TN status valid for that period (one year in the illustration) and not three years. The three-year TN will be available only when the TN employer seeks the three-year employment and not less. In other words, the three-year TN is not, repeat not, automatic. It will depend on the employer's need as requested in the employer's letter. "

Has anyone recd. a 3 year TN ?

Just got my 3-year TN this past Friday at the Peace Bridge POE.

No question asked, just as easy as the old 1-year TN.

Did your appt. letter mention that you were going to work for 3 year (or did it mention any duration). ?

I am going to be at Peace Bridge next month to renew my TN.

Just got my 3 year TN at Brownsville TX -- Matamoros, Mexico.

The officer was going to give me 1 year TN, I told them rules have changed. They didn't know anything about it, and I told them it was put on Register in Mid-October, so they went back checked it out, and re-printed 3 year TN I-94, and TD for my wife.

The fee is only $50 + $6 + $6.
