3 Questions before entering DV Lottery

Hello Everybody

I'm going to enter the 2015 DV but I have 3 questions before starting to proceed

1- What will happen if I enter the lottery and WIN, but I don't have the conditions to leave my country? For example I might have to wait for my Military Service situation to be sorted out and I might not be able to leave my country in time. Can I postpone the interview for 1-2 years? If not, will I be banned from entering the lottery for the coming years?

2- Me and my partner are planning to marry in March 2014. But I want to fill one form and enter my partner's information in the Spouse section. But the question is that we are not officially married yet. Will that be a problem if we win? Will they ask why you stated that you are married when you were not officially married yet?

3- If we fill the form and win, can we both enter US and gain Green Card? or my partner should wait longer before entering US?

1. You can't postpone you interview 1-2 years. If you win DV-2015 your visa has do be issued by Septemer 30, 2015 or it's gone.
2. That will disqualify you. In case you win you can add your spouse to your case after you got married.
3. Only if you are married.
 
To add to above: your visa has to be issued by 30 Sept 2015 and then you have 6 months to enter after visa issuance. You have very little control over when your interview is first scheduled (you can delay it by sending in your forms late if you win, but that can become a risky game if visa numbers get exhausted or if you go under AP late in the fiscal year); whether or not you can postpone it once scheduled depends on which consulate you interview at. Some will happily reschedule, others only do so in verifiable cases of emergency. In any case, as above visas have to be issued by Sept 2015. You have absolutely no claim to a DV visa once the fiscal year ends.

But to answer your other question, if you win and then abandon the application, you will not be precluded from entering again.

You mean I should not fill my partner as spouse and then if I win and after getting married, I should introduce her as my wife? If I do this, can we enter US at the same time or she has to wait longer?

Are you sure that what I said will disqualify me? Because we will get married before they announce the winners. The timeline would be something like this:

October 20: Filling the form (and put my partner as my spouse)
March 2014: We will get married officially
May 2014: They will announce the winners

The point is, will they check our marriage date?
 
You will have stated falsely that you are married as of October 2013.
They will see from your marriage documentation that you were married in March 2014.
They will see that you lied on the application form when you entered.

Disqualified.

It really is that simple I am afraid.

The moment you get married you need to update them on your latest marital status and file an immigrant petition for your wife. She will be scheduled an interview at the same time as yours. Be warned that consular officers are especially cautious about marriages after DV selection due to history of sham marriages, they will want proof that yours is bona fide. Having a marriage certificate alone is not likely to be enough, you will need more evidence such as wedding pictures, old pictures of the relationship prior to marriage, joint accounts, same address, etc.
 
OP is planning to get married before the selection results are announced, which will help.

If you are selected, send a DS230 for your wife as well and a copy of the marriage certificate to KCC. She will then be invited to the interview as well and you will both get green cards (assuming all qualifying criteria are met).

Apply for the eDV as single since you're not yet married. Go ahead and get married in March 2014 as planned. If you're selected in May 2014, you will include your wife in your selection by filling out DSP 230 form for her and send it with your own set of forms that you will be sending out to KCC. You will need to include a copy of your marriage certificate as evidence of your new status.

Because you would have gotten married before the results were announced, your marriage isn't likely to be put under extra scrutiny at the time of the interview IMO. Your wife of course would also benefit from your selection and she will be able to go to the US with you (following a successful interview) because you've included her as your derivative when you send out the forms to KCC.

So each of us will fill a separate form as single and if any of us win, he/she will include the other one, correct?
