3 month requirement: At date of filing or interview?

Hi Dhs, how far were you into the application before they denied your application?

I just got fingerprint notice and I fear I'll be denied. If they're gonna deny me, they might as well do it right now so that I can file my application immediately.

We completed the whole process, successful interviews, tests etc. They said they needed to do this in case we wished to appeal (they said we had no chance of winning an appeal). My daughter and I received our letters. They don't use the word 'rejected' rather that we were ineligible to apply based on the state residence requirement.

My wife is still at the interview stage according to the website. I'll let her application play out.

I'm not sure whether you can withdraw our current application without prejudice.

Are you guys sure?

Can someone explain this paragraph?

"
In cases where an applicant has filed early and the required three month period of residence in a State or Service District falls within the required five-year period of continuous residence, jurisdiction for filing will be based on the three-month period immediately preceding the examination on the application"

What does "the examination on the application" mean?

"Examination" is the interview.

I think this probably relates to when you can apply in the 90 period just prior to completing 5 years residence.

I don't think there's an analogous early application period for the state residence criterion.

like I aforementioned, I moved to a different state, lived there for 2 months, took a trip abroad, flew back to the same state after 3 month trip, and moved back to CA immediately after.

Technically, I'd been a resident of CA for over 14 weeks (before the day of filing) but I fear my decision to change the address on March 30 will hurt my causes. :(

As for me, I have never really moved out of the USCIS District or my state - only have been changing residences within the state. Now because of my economic situation (recent college grad) I have never signed a proper lease. I have just been living/moving around in temporary apartments that I found on Craigslist. I don't have anything like utility bills, but I did diligently file the AR-11.

Hopefully they don't punish me for not being rich enough to sign a 1 year lease.

Oh well, we'll see. I'll keep everyone posted.
