2nd EAD - wrong dates

Hello,

Recently, I received my 2nd EAD (about 3 days ago), however the dates on the new card are same as my previous (1st EAD card-current EAD card):mad:. Luckily i just noticed it. My question is how do i go about correcting it?:confused:

Do i just call USCIS customer service to have the dates corrected or should I take a infopass and contact the IO at DO. I am extremely nervous as we are closing on our house in 15 days and wanted to have the 2nd EAD in my hand.

Please advise on my next steps. MY timeline is as below:
 
For renewal of my EAD.

When I called USCIS customer service, they want me to fill out another I-765 form and return the card they sent me. If i send the form and card back to USCIS, would I be still subject to 90 day rule? Will DO be able to issue a new EAD card with correct dates? Taken Infopass appointment for next week.

Does anybody have experience with error in their EAD card and how did they go about in correcting the mistake?

Please advise.

Error on EAD Card

As I was told to fill out new I-765 form and mail the EAD card back in, I went to USCIS website to print the I-765 form. However, there seems to be an error on the form, every time I try to open the form. Is anyone having the same problem.

I had same problem. The date on the new card was the same as old one. I filed a new I765 with a cover letter explained the situation about 10 days ago. I did not get any thing back from them yet. No Receipt Notice !!

To be able to open I765 form, you need to download the Adobe Reader version 8 !!
 
Following up with USCIS, I have been told that I was sent new card with old dates (USCIS assumption) that I had lost my card even when I requested EAD as renewal.

I had applied about 6 months ahead of my expiration becos the fees were increasing and wanted to have it in my hand before i close on my house. But it seems that since I had applied so early out, it should have been denied. They are citing that EAD cannot be applied more than 90 days from expiration.

Does anyone have similar experience!!

how far ahead did you apply for your EAD? When did u apply for ur EAD and when does your current expire? I also sent you a pvt. message!!

Why is the USCIS making mistakes when it clearly states the below in their official website.

"Employment Authorization

U.S. employers must check to make sure all employees, regardless of citizenship or national origin, are allowed to work in the United States. If you are not a citizen or a lawful permanent resident, you may need to apply for an Employment Authorization Document (EAD) to prove you may work in the United States.

USCIS issues Employment Authorization Documents (EAD) in the following categories:



EAD: This document proves you are allowed to work in the United States.

Renewal EAD: You should apply for a renewal EAD six months before your original EAD expires.

Replacement EAD: This document replaces a lost, stolen, or mutilated EAD. A replacement EAD also replaces an EAD that was issued with incorrect information, such as a misspelled name.

The I-765 clearly allows you to chose between a renewal EAD and a replacement EAD.

I am applying for:
Permission to accept employment
Replacement
Renewal of my permission to accept employment

Why don't they just follow what is checked instead of *assuming* anything! :confused:

This makes no sense - I think they just screwed up and now they won't admit it.

Where did you get that you can not apply for the renewal more than 90 days from expiration date?

The USCIS website says the EAD renewal request should send out at least six months before expiration date.

Thank you k. ambrose for the link. I am going to take it with me when I go for my infopass. The information is really helpful in terms of arguing against USCIS stance that I had applied for my renewal way early.

As for the infopass I am going to take the copy of my filled out I-765 form where I clearly selected renewal option and not the replacement option. My question is what do I now for time being, should I go ahead and re-apply for another EAD card (my 1st EAD expires in 90 days) while I am disputing this mistake with USCIS?

Somebody from USCIS gave the rationale as to why my new EAD card has the same dates as the 1st EAD. Their justification is that since I applied about 6 months early, they assumed that it was for replacement of my 1st EAD.

But what "check box" was checked on the application? Do you have a copy of what you sent it? If it was in fact checked as a "renewal", then it was clearly their mistake and they should fix it and not have you pay any new fees.
 
Yep, the copy of the form that I sent them. I am trying to figure out what to do while I m resolving this with USCIS, time is ticking away. My 1st EAD expires within 90 days and if I am forced to re-apply then I need to apply now.

Please advise, as I am trying to figure what is the best approach? Is EAD expedited in special cases like this? (Assuming that I allow 15 days for resolution to this issue). I have an infopass appointment next week.
