Please share your experience with 245i.. Did anyone had interview or approval from 245i. Please let me know. thanks. One more question, How do INS know that you worked illlegally in the past (13 years ago I worked at Mcdonalds). Please let me know. Thanks.

I have heard of people say that usually they will call you for an interview because you invoke 245(i), as it is a non typical case. As far as how USCIS knows if you worked illegally almost 13 years ago, almost nil. Unless its on your social security record or something or somebody has an axe to grind against you. But legally, you are supposed to disclose it. A lawyer can advise you as to how to go about it.

were u on payroll? Did u worked and used ur SS no? or u they just paid u as cash salary?????

even u did ... what is ur concern about ur pettition? pls share full story so anyone can try to response.

I came to this country 14 years ago as F1. I got my social sec # without saying anything on it. I worked in Mcondalds for few months. then I finished my first degree then I moved to different state and I went to school there. I worked for the temp agency (some clerical job) using my ss# and I used to receive paychecks every week. I have been filing taxes for the last 14 years. I worked for the temp agency for 1 1/2 years. Then I got out of the school in 1996 with the Practical training and i started my carrier. then i got my h1b visa for 6 years. after words everything was fine. My concern is do you think INS will find out about my employment history in the past. (1994-96). Please help me and let me know what should I do. I have not told me attorny about my past. I don't want to confuse her. she will get mad at me if I tell her now. Since I had 2 months gap between employment (during my transfer H1), my attorney applied 245i with $1000 payment along with my 485 application. Please advise me. I am confused and worried. thanks for all your help.

No need to worry. Your lawyer did the right thing. As you are eligible for 245(i) (I would assume you are), you should consider yourself lucky. Otherwise you would have to do CP. As you used your SSN when working for the temp agency, I would assume that its on your social security record. Plus you were paid through banks. If I were you, why sweat about it? Your lawyer already send the waiver, so you should have no problem.
 
thanks for your response. under 245i covers only upto 6 months. Am I right? Do you think the INS has access to the history of your earnings? My attonney filed for 245i because there was a gap in my h1 tansfer. She did not know anything about my past. Please let me know what should I do at this point. thanks.

Why on earth were you not honest with your lawyer? Its not like, he will go tell the USCIS about it, he is YOUR keeper like a doctor.

But anyways, you really should tell your lawyer about it. Maybe, 245(i) will also cover your unauthorized work. I don't know. You might still be eligible for AOS, if you use 245(k) if I am not wrong. Explore that option with your lawyer. You might be able to file an amendment to your 485 or something. Or the other option is to sit tight and not tell anybody about it. You probably will even get your AOS approved, but you will always be in tension as someday it might come back and haunt you. I really think you should sit down with your lawyer and explore your options. Hey, if everything fails, even CP is not a bad option if you have a steady job. Do the right thing and be conservative when it comes to immigration, thats what I feel.

Let me tell you my friend........this world is not perfect.......and no one is perfect.... except God..... got it...... so pls stop worrying .....and start smiling.... even u are in mstake..... worry only make u more nervous.... and double your trouble..... nothing else...... so just relax.........

let me share ppl story..... around in this fourm..... many ppl filled 485 on employment bases... they were not sure about their status..... when INS officer find that somthing is mismatch .... he don't deny application or kicking them out..... they just send RFE to prove ur status while abc year to xyz year......ppl who didn't paid 245() they were asked to pay fine 245() $1000 and their cases were adjusted..... they all got GC...


you already paid 245 fine ... and if they think ur status can't be adjusted they will ask u to correct this or they will switch u blah blah catagery....and will ask you to send Govt $$$ and wash ur sins.... hehhee :) thats all.. what is big deal....... maximum they can ask u ..... that hey.... Mr. blah blah.... you filled 245(?) .. pay more $$ and correct 245(??) thats all he will do........ he is not hanging u....... so relax..

Just wait patitnetly...... till ur files opens...... if INS officer finds that there somthing need to be corrected...... then he will ask it.......to correct it.... thats all......

so after reading this....... just ........RELAX.....don't panic.....

ur case si fine... u are here for 13 yrs..... and even u worked almost everyone did....... its not big deal.....

BTW they do expect ppl work here and they asked many ppl how did u servive and who support ur Bills??? most ppl say SIR I MEET BLAH BLAH EMPLOYER he promised me to take care of my food and arrange one room to live... and I work for him......END OF STORY.....

there is 10 million ppl who are working.....without doc.. and enjoying their life....whats wrong with u?

you worked fine....... its not a BIG crime....u just violated INS rule.... and $$ 245 fine willl be okay fo u.... don't worry about catagery.... ur attoreny did good...and correct...... even u think ur catagery is not correct in 245() so lets see what they finds about it........ don't worry........

talk ur attoreny if you are still not satisfied........ and u need peace in mind.....

Answer only question what you were asked.
