245i eligiblity question

Let's say PersonX's priority date is Apr 29 2001 and PersonX falls "out of status" at a later point, say Jun 2001 to Feb 2002. Is he still eligible for 245i? Or the out of status must be before Apr 30 2001 to be eligible for 245i.

Any ideas ...

You might need other documents to prove the legal status for other periods. Also priority date proof (which they have) but again they question us.

There are no in-status requirements for 245i. One of the most likely areas of investigation would be to prove physical presence in the US on December 22nd, 2000 - which is a 245i pre-requisite.
