221g - your application is not clearly approvable at this time

Our H1 and H4 reavalidation was refused at DC under 221(g) - application not clearly approvable, must have an interview overseas... I'm from India and am planning to go back to Chennai for Stamping. Has anyone successfully got the visa stamped from Chennai after this kind of rejection from DC. I'm on the 7th year extension. I was never on the bench and continuously employed in the last 7 years. Please share your experience. Thanks.

I got the same kind of case but i have been in US for only 4 yrs and planing to go for Chennai consulate to get the visa on August...

I got 221 g rejection when I sent my Passport to St Louis for revalidation. The reason was "Not clearly approvable at this time. Please visit a consulate for the visa."
and my previous expired H1-B visa is stamped "CANCELLED without prejudice"

In the DS156 form what should answer for the
question 31
Have You Ever Been Refused a U.S. Visa?
question 35
Has Your U.S. Visa Ever Been Cancelled or Revoked?

I'm going to talk to my lawyer about this tomorrow. I shall ask him about the questions 31 and 35.

I mentioned in the DS-157 form that I was in Malaysia (I was in transit, but didn't specify it). Could this be the trigger for the interview with a counslar officer abroad? I'm just trying to find out the reason for the 221g. Any advice? Thanks.
 
Actually i have mentioned i was in "The Netherlands", i was working there for 2 months. Do you think its good idea to go Chennai consulate for stamping, What if i continue here till i get my green card, which is in process... I will also going to talk about this to my attorney.. i may have some details for you as well by tomorrow evening and also planing to ask online live chat with marthydotcom... let us see..

same 221(g) problem

Mine also got rejected on 221(g) reason, saying "....... its not clearly approvable at this time, please go to out side US and get visa.... blah blah blah " :mad: :mad: :mad:

I have sent in april end, got back last week (17th). I think, lot of people got 221(g) on that date. I guess, they just thrown pending PPs back on that day, with out waiting for information they are expecting from back ground check or some kind of information they are looking . They do check for some 5 to 10% randomly selected applications. As they are closing on 16th july, so they flushed unfinished applications with 221(g). Thats what I am guessing. I am from India. I dont see any other reason in my case. My company got 3 approvals in last 3 months without problem.

Planning to go to Delhi or Calcutta. Chennai waiting period is very high. :confused:

is any problem for stamping in Mumbai

for my case also they have rejected for revalidation. if we go India for stamping , is there any problem with stamping on h1b ? Anybody is planning for stamping h1b in Mumbai who rejected from DC.

I haven't talked to my lawyer yet about the questions 31 and 35. I asked about the rejection and he didn't have any idea about the reason "clearly not approvable....'. I shall try to find out about the questions 31 ans 35 from him. Do you have any update on them? I'm planning to go for stamping in septmeber. Is there anyone who got the h1b visa stamped from chennai after refusal from DC?

Please let me know what could be possible reason's for 221g rejects I am on the same boat I have been working for 4 years sent for visa revalidation.
got 221g rejection asked me to attend interview at consulate.

Hi I sent my visa for revalidation on May10 got back on july 15 with exactly same reason 221g I don't see any reason for rejection.I am going to India Jan 2004 Please share your experience if you go earlier then that.

Mine case is laso says same. I sent on 20th May, got back on 24Th July 2004.
It is same stamped " Cancelled without Prejudice" and Last point ticked in the form.
This was my New employer Approval, working with them for last 11 months. I already got another renewal 2 years back in US, but was then same (ex)employer approval and renewal -extension.

My I797 approval is till June 2006?

I am waiting for last stage of my Canadian PR immigration process, There my last date on Medical is 28th July and it is expiring. But Consular left a message for me saying they are about to process the finalization of my case and I may get medical extension for another month.

As my canadian case was going for last 2 and half year. I don't want to lose that. But if I land there I will have to get my Visa stamped there?

Please suggest me How should I extend my stay here in US.
I have family, 2 kids, job going for last 4 years ( 3rd employer now, 2nd employer had approval -worked for 8 months but not got stamped) My 2nd renewal was from first employer till 15th June 2004.

Would it be risky to go to Toronto for stamping if I land there?

I have a lot questions coming to mind .. Confused bit..

Hi

Mine also got rejected under 221g- not approvable...
They had received my papers on 9th July'04.
By looking at immigration web site post, somebody sent us in this thread, looks like it is serious in nature with some 26 point check etc.
I am trying to find out from a lawyer what it means etc.. which i would post soon.
I was planning to go to India-new delhi in Dec'04.

I dont understand by rejecting simple cases with W-2's filed every year and no other bad record, what is it being trying to prove.. but it surely is frustating..

I called up 202.. number but they do no give any response at all.

The 221(g) Ineligibility: If an applicant is refused under this section, it is because she/he is missing a document or some other piece of evidence which the Consular Officer needs in order to render a final decision on the applicant’s eligibility for the visa. Generally, the applicant will be told what types of documents might satisfy the Consular Officer. A new visa application form should be filled out; however, no new application fee is due for a period of one year following the initial 221(g) refusal.

If you have been refused a visa under Section 221(g) of the Immigration and Nationality Act (INA), you may reapply at any time. At the time of refusal, you will be told whether you can reapply using drop box facility, whether you have to come in person after making an appointment or you can apply in person without any appointment.

If you reapply in person, please bring your refusal letter with the 221(g) stamp to the Visa Section entrance and ask to re-apply.

If you are told to come in person without appointment, you have to just appear at the consulate in the morning. (Mumbai - 10.30 AM, Chennai before 9 AM on any working day from Monday-Wednesday). You don't have to fill DS-156 again. Old DS-156 supplied with original application would still be valid. You do not have to pay the application fees again if you reapply within one year of earlier rejection. You have to carry only visa issuance drafts with you. Visa rejection under section 221(g) is not actually "rejection". It is visa ineligibility. It means the consular is unable to determine the outcome of the visa application at that time. The possible reasons are, missing documents or personal appearance required. You have to your passports at the consulate office the next day. This follows from the fact that the logistic fees paid at the time of drop box application had been used for delivering the passports. They will not deliver the passports twice for the fees were paid. Also note that application center will not provide any service since you did not have an appointment. If you want service then you have to purchase tickets.

If you have been requested to wait until the Consulate contacts you, please do not make an appointment. Your case requires further administrative processing and the Consulate will contact you once this has been completed.

I spoke to Lawyer, he is not much aware about 221g.
I am trying to find more info. from other sources, will post as soon as i get more info.

H-1B Refusal

Hi ALL

Would anyone guide me by his/her experience of h-1B refusal?

Actually I was refused my H-1B at US COnsulate,ISLAMABAD,PAKISTAN.
Visa officer didnt tell me any pre-defined reason oif refusal.He just raised an objection that he assumed that I might have got job with help of one of my friends whose name I did mention in DS-156 I had plans to live with while being in USA.
He also didnt give me back my I797B form (H-1b Approval).Kept all forms (Ds-156/157/158) and H1b Appreoval letter copy which was sent to me by employer.
Now what if I want to re-apply,do i need that original copy?
Though I have photocopies of it,but someone told me to get that original one back from EMBASSY.Now would anyone guide me how to get that back?

Would embassy give me that back?
