2 yrs EAD proposed law at OMB Vs 6 months processing at USCIS, doesn't match

Hi,

there is a law now under review at OMB that suggest to extend the EAD of i485 filler to 2 yrs instead of the current one which is just 1 yr.

USCIS says that it will make all applications processes under 6 months soon and by 2006. very good, this means that when u fill an i485 it should be cleared in 6 months. example: now is the new pilot program in csc to get i140/i485 in 90 days.

if we compare those 2 events, this bring us to a contradictory conclusion which is: u can have ur i140 and i485 cleared in less than one yr (say 6 months) although u will be issued an EAD for 2 yrs. it is completly illogical. why they don't keep then the EAD as it is now for 1 yr?

can u analyse this mismatch in information?

It won't matter. Once anybody gets 485 approved, they have no need for EAD. They can directly use their green card as valid work authorization.

However, for some reason (say for example, security check or medical condition), if the adjudication of 485 gets delayed for a long time (1 or 2 years), then the beneficiary will at least have the benefit of a EAD that is valid for a longer duration of time...This will eliminate filings for EAD renewal and will give more time for USCIS to focus their attention on other cases.

Also, don't forget that there are thousands of 485 cases that are already pending. At least, this new law can eliminate the need for them to file for EAD renewals repeatedly.

I agree !00% on this one...It will 3years for I140 pending approval next month
