2 years before VSC initiated background check!

Hi all,

I recently submitted a letter to my local NJ Congressman (Rodney Frelinghuysen) as my I-485 RD was Dec. 07 2002 and after initating an inquiry with the USCIS on Oct. 27th of this year I got a letter stating that due to security checks and manpower shortages there are delays, blah, blah...

I got a very quick response from my Congressman's office which is great but to my surprise they mention that my security name and date of birth check was only initiated on October 2nd 2004!!! Almost 2 years after my initial I-485 application! I have had my fingerprints taken twice and when I checked my fingerprint status I was told they were sent back on the same day, back in July of this year.

So, I am now facing a situation where the USCIS obviously messed up by not even submitting my background check until just recently and according to my Congressman's office there is no way to expedite the security clearance. What a joke! I am so frustrated by this and I'm wondering if anyone has any suggestions as to what I might do next? I emailed the FBI back in early November asking what my background check status was and never got a response.

Anyone got any ideas???

In a precise and concise way, outline the USCIS errors as you stated above
and fax an EXPEDITE REQUEST to USCIS. Follow the URL

In the letter from my Congressman's office it states that the background security check cannot be expedited. Does anyone know if this is actually the case?
 
Its a complicated issue

Toners, while that may not be actually true, no politician or govt
official , these days, would be willing to expedite this, because of the
sensitivities involved.

Even if you were the most plain and simple harmless guy in the world
( which I assume you are ), imagine a congressman being thrown a bummer
2 days before the election, by his opponent, saying he expedited the backrgound check of an alien.

These folks are career politicians. They would only help you or me if they see
a gain. Not a chance otherwise.

However, let me add , though, that , the EXPEDITE Request is no
guarantee that it will be EXPEDITE-d. That's entirely upto the whims and
fancies of the Gods at Vermont. But if you have facts to back you, your
chances are higher.

I have heard that their CRITERION for granting such a Request are of the
order of....your brains coming out of your head w/o I-485 or stuff like
giving you a I-485 will lead to every US citizen becoming a millionaire...
things of that order and magnitude..pretty insane stuff.
 
Agree. Initiating any inquiry by any means has no effect. If approval comes after few days of inquiry it is mere coincidence. You may get some useful info but at last that info is of no use. 485 is all or none application. I have not seen a single case where congressman has forced USCIS to look into the case. It is like asking someone to give a mortgage lone at 1% APR. LUCK plays a big role and if time is not with you better concentrate on something else ( like job, sports, vegas and what not )

I have therefore gone in for Personal Letters of Request addressed
directly to Director ( Paul Novak ) and Deputy Director ( Sandra Bushy ) of
VSC.

My only contention, thus far ( and I am not gonna harp on it any more )
has been that if we had a very very very focussed effort where around
50 or 100 2002 applicants actually used ONE SUCH LETTER and signed it
( in INK ), addressed to VSC Director and Deputy Director, it could have an effect.

Otherwise I have scant hope of an individual applicant's letter ( like mine ) having any result or impact.
 
Number Game

Problem is that among 50 people who filed in 2002 and browsing this forum, around 25 are in no hurry ( happy with job / life / home ). Rest 20 will not “sign” anything for 20 different reasons. Remaining 5 makes the number too less. And no one can be blamed, everyone takes a decision based on his / her perception.

Maybe its 4 instead of 5..which leaves me...just 1. And that's what I am
doing.....a personal letter addressed to VSC Director ( CC To Deputy
Director ) asking for help and intervention.

Having exhausted all options ( the only one I haven't tried is the EXPEDITE
FAX ), I have zero belief in any other path or route, at this point.

The fact is that, many senators and congressmen don't care about a potential GC holder because he/she cannot vote. And, even after getting GC it will take five more years to be eligible for voting for him/her. Immigration always has been 3rd rail in politics. But sometimes someone gets help - may be a very few. This is just one of them I read couple of months back:

I have applied my I485 in Last Week of Dec 2002 and when I heard last from FBI in the Last week of Oct 2004, that they have not yet received any request from USCIS about my Name check..... and I am still not sure whether my name check request has been sent to FBI or not.

I'm in the similar situation as you but filed with TSC center. My case was stuck and pending due to FBI name check. I did FP two times and still no status of NAME CHECK. Contacted congressman, my lawyer, famous 800 and FBI name check office. It's all useless.

The only thing is to wait for another two or three years, then packed home.

I did what Sumanta suggested and faxed through an expedite request on 12/06. On 12/08 I received a faxed response from VSC. The response had a list of possible replies including expedite request denied. I had an 'X' placed beside the "The processing of your petition/application has been delayed. All petitions/applications received by this Service are required to have routine security checks that are resulting in the delays of the adjudication of petitions/applications...." option.

So, it's not like the request was actually rejected but seems to reinforce what my Congressman's office had stated. That the USCIS has no control over how long it takes for the FBI to complete the name check. My issue of course, which I stated on the expedite request, was that the USCIS should have initiated my check a lot sooner than October of this year, almost 2 years after my application was received by them. I have done all I can do now, it seems I have to continue playing the waiting game...
 
Count me in...

I am in the same boat. VSC has never requested name check. I applied for March 2003. I asked Congressman but as you guys say

Have you guys tried to go to local office and talk ?

I am so worried and I don't really know what to do now and make USCIS work on my Name Check Process.................

I received an email today from FBI Name Check Dept for the email dated on Oct 8th about my name check status and it says that they have not found my Name on the USCIS request list and he is asking me to contact USCIS about it. I have filled my application in Dec 2002 and its been two years now and I don't know why USCIS is not working in a legitimate proper FIFO Process.

Is there a way by which I can make USCIS work on my case without any further delay. Any inputs will be really greatly appreciated. :)
 
Hi Needhelp1,

I would suggest contact your attorney and see if he co-operates. If he doesnt then i will suggest get your congressman/senator involved. Now being the holiday sesaon its difficult to get things moving. Also whats your current status ? Meaning what are your RD/ND,FP,RFE if any etc.

did you try for a status enquiry, What is the message you receied from uscis, I guess you can figure it out little bit where you are. For my status enquiry they sent a reply stating, pending for service considerations, honestly I can't figure out, whether my name check was done or not :mad:
