2 year HRR

Hi

I already have a 10 year B1/ B2 visa obtained for a business visit purpose, and I am applying for a J1 visa now. Can I travel on my B1/ B2 visa to make personal/ official visits within the 2 year restriction period? Similarly, I hope there is no problem in applying for the F1 within this restricted period.

Also, is there a time limit for the 2 years criteria (say restriction is at max for 10 years, or so)? Can I make up the 2 years in parts (say 1 year, then a stay overseas, then again 1 year, or so)?

Answers would be really appreciated.

DOS is not required to cancel your B visa.

The 2 yr HRR only precludes you from obtaining an immigrant visa abroad or adjustment of status in the U.S. or from obtaining an H or L nonimmigtrant visa abroad or COS in the U.S.

IF actually subject to the 2 yr HRR under INA 212(e), it does not go away until either fulfilled or waived (or in a rare case of it being affirmatively officially retroactively rescinded by publication of a new skills list in the Federal Register). The requirment does not go away even if you naturalize in a third country (and time spent in a third country does not count).

The skills list was just updated in 2009, prior to that the last update was 1997.
