2 times CBP Denial, should we mention the denials in USCIS petition

Hi,

I have been denied visa twice at the visa due to insufficient document and filled under incorrect category. Now my organization wants to file petition under USCIS and I have told them to write a support letter about previous denials but organization's attorney are suggesting that its not required because CBP and USCIS functions different and if I had previous denial on USCIS then only I have to mention. Please advise if it is true as I cannot afford third rejection.
 
Another question I have is, last two times I visited POE in Maine and I really wanted to go by air this time if USCIS petition gets approved and do not cross the border and check on Toronto airport itself. My attorney filled the petition n saying to identify Maine Houlton border if it gets approved. It is important to go on same border or I can try Toronto Airport too for my TN1 visa.
