1. Can one apply for LC without having 2 years of work experience (with Diploma and 1 year experience).

2. When LC is sent to SESA, does SESA reply with PD or PD is implied to be assigned whenever it (SESA) receives it (if sent on May 1, PD would be May 3)

1. Can one apply for LC without having 2 years of work experience (with Diploma and 1 year experience).
It all depends upon Job requirement. If the offered position does not require any specific skill or education then one can apply for LC without having 4 year degree or # of years of experience. But it's hard to convince DOL that employer is not able to find any candidate.

2. When LC is sent to SESA, does SESA reply with PD or PD is implied to be assigned whenever it (SESA) receives it (if sent on May 1, PD would be May 3).
PD is when they recieve it

That's right. A lot of offererd (even RIR) position for LC does not require 4 year degree (like foreign cook). They are only based on special skill and experience. But for those candidates it is comparatively easy for sponsering employer to proof shortage of candidates and they get LC approved. We are tracking approved LC in Philly DOL for last 4 months and you will be surprised to know that 15-20% of approved cases go in that category (checked in AVM, based on randomaly selected case #).

We don't know in what field one has "Diploma and 1 year experience". You can file but DOL might come back and question "shortage of candidates" due to very minimal requirement employer is going to put for LC. It is hard to belive that employer was not able to find a qualified candidate when employer was not looking for any skill/education/training or # of year's of experience.

 
Thanks. This is not for me(I'm a mortal IT :) ), a friend. He's an industrial Engineer (whatever it means) and his lawyer insistis Diploma+1yr should be hard but quite possible.
